Dear Comrade,

 

            We append hereunder a copy of the letter we had addressed to the Secretary Expenditure, Government of India, demanding that the calculation ceiling be raised to Rs. 3500 in the case of grant of adhoc bonus.  The letter pertains only to adhoc bonus as the orders relating to PLB are yet to be issued.

            We request all affiliates and COCs to send similar letters (with necessary modification for those covered by PLB Scheme) to the Secretary Expenditure immediately on  receipt of this communication with copy endorsed to the CHQ.

            It has come to our knowledge that the Govt. might raise the calculation ceiling to Rs. 3500 either to the Railway workers alone as was done in 1996 or for all those covered by the PLB Scheme.  This, if done will be a gross discrimination in respect of employees covered by the Adhoc bonus and must warrant immediate action programme including strike as was carried out in 1996.  We request our affiliates and COCs to prepare the rank and file of the workers for such an eventuality.

            As per the decision of the National Executive Committee meeting, we have addressed the Secretary General, All India Defence Employees Federation to explore the possibilities of organizing a united action in pursuance of the unsettled demands of the Charter pertaining to the 6th CPC issues.

            We hope you must have gone through by now the various instructions, rules, and orders issued by the Government in implementation of the 6th CPC recommendations and must have noticed certain incongruities, anomalies and other difficulties. We have been receiving such complaints from the members of different organizations.  We, therefore, request you to kindly go into this matter and send us in writing such anomalies and incongruities noticed by you or brought to your notice by the members to enable us to make representation before the Government.

Madam,

 

            We solicit you kind reference to the O.M. No. 7/22/2008.E-IIIA dated 5th September, 2008 granting adhoc bonus to employees who are not covered by the PLB Scheme for the accounting year 2007-08.  It has been mentioned therein that the calculation ceiling of Rs. 2500 would remain unchanged.

 

            As you are aware, the calculation ceiling of Rs. 2500 was imposed in consonance with similar provision in the Bonus Act as is applicable to industrial workers. The said ceiling of Rs. 2500 was raised to Rs. 3500 by the Government and made applicable to the workers covered by the Bonus Act for the accounting year 2006-07 itself.  We had taken up the issue both through correspondence and in the JCM Standing Committee immediately on promulgation of the ordinance raising the ceiling limit to make it applicable to Government employees.

 

            We expected the Government to raise the ceiling limit to Rs. 3500 before orders are issued for the grant of adhoc bonus pertaining to 2007-08.  We request you to kindly issue necessary orders to raise the calculation ceiling limit to Rs. 3500 applicable for the grant of adhoc bonus for the accounting year 2006-07 onwards.

            We confirm having sent you the following message on 24th. The Departmental Examination for inspectors and others have been postponed. The DIT's letter in F-No. DE(20)(8)/2007 /DIT dated 24.08.2008 is enclosed .

            As you are aware we had been pressing hard for the relaxation of the rules, where by candidates who have crossed the age of 55 and availed more than 10 chances could take up the 2008 Examination This was promised by the board on various occasions in formal and informal meetings but was ultimately rejected when the full Board met twice for considering this issue. We had to take up the matter once again and after a fruitful discussion with the member [P] on 24th it was decided to postpone the examination to be held in November 2008 with the requisite relaxation.

            You may kindly advise the members that this would be the last chance available and therefore prepare for examination in all seriousness with the extended time now available. We are awaiting the Directorate's revised schedule and instructions in this regard.

            We met the chairman and secretary ( R) on 25th on behalf of the central JCA to discuss the 6th CPC related issues. The presentation made by us before the board and secretary( Revenue) is appended hereto.  On 24th the CoC of organizations in the Department of revenue met to explore a common approach. The recognized Federations/ associations in the CBEC have met their authorities on 25th. We shall now await the outcome of this effort. The COC is scheduled to meet again on 20th Oct. 2008 at Mumbai and review the progress in this regard and chalk out programatic actions in pursuance of these demands.

            On various other departmental issues, which are included in the charter of demand of the JCA, there is not much improvement to report except that chairman has ordered that the reimbursement of mobile phone charges should be extended to all employees. This direction has however not been translated into specific orders enabling the employees to get the benefit thereon. We therefore request that all attempts be made to make the progrance of action, which are to commence from 1.10.2008 a success. All attempts may be made to make it a joint and united action by the members of ITGOA and ITEF and if for any reason the participation of members of ITGOA could not be elicited   the program must be carried out independently.

Memorandum presented to the Secretary Revenue on 25th September, 2008

Tax Assistants / Steno Grade-III :

They are presently in the scale of pay of Rs.4000-6000. The recruitment qualification prescribed for Tax Assistants is graduation with data entry speed of 8000 character depression. The 6th CPC vide its recommendation in Para 3.1.12 and 3.1.15 has stipulated that the recruitment in Government service hereafter will have to be in the grade of Executive Assistants. Thus there cannot be any further recruitment in this cadre. It would therefore, become necessary that those who are graduates with one year diploma in computer, among the Tax Assistants are upgraded and placed in the PB-2 with a grade pay of Rs.4200, immediately. Similarly those who have completed the residency period of three years (the period stipulated by the Department of Personnel for promotion from 4000-6000 to Rs. 5000-8000) may also be placed in PB-2 with grade pay of Rs.4200. Those who are not graduates and those who have not completed the requisite residency period of three years may be placed in PB-2 with grade pay of Rs.4,200, after completion of requisite residency period or accquistion of the above mentioned qualification, as stipulated by the 6th CPC.

Senior Tax Assistant / Office Superintendent of Incometax Stenographer Grade-II and Stenographer Grade-I:

The Senior Tax Assistant and Stenogrpaher Gr.II are presently in the scale of pay of Rs.5000-8000 and Office Superintendents and Stenographer Grade-I are in the pay scale of Rs.5500-9000. These grades have been merged and are placed in the PB-2 with grade Pay of Rs.4200. Office Superintendents and Stenographer Grade-I are the promotional grades for the feeder cadres of Senior Tax Assistants and Stenographer Grade-II. As per the recommendation of the 6th CPC they will be placed in PB-2 with grade Pay of Rs.4200. However, it is to be mentioned that office superintendents are the supervisory grade and the merger of the grades of Senior Tax Assistants and Office superintendents into one singe cadre will result in the depletion of the supervisory grades in the Department. It is therefore, necessary to functionally assess the required number of posts in supervisory grades and upgrade that number of the posts of Office Superintendents to the grade of Administrative Officers Gr.- III.

Administrative Officers / Private Secretaries / Inspectors of Income Tax :

CCS (Revised Pay) Rules 2008, in part 'B' – Section – I - para (ii), under the head REVISED PAY SCALES FOR CERTAIN COMMON CATEGORIES OF STAFF, at page no. 44 and in part 'C' – Section – I - para (ii) under the head REVISED PAY STRUCTURE FOR CERTAIN POSTS IN MINISTRIES, DEPARTMENTS AND UNION TERRITORIES at page no.49 states as under :

"On account of merger of pre-revised pay scales of Rs.5000-8000, Rs.5500-9000 and Rs.6500-10500, some posts which presently constitute feeder and promotion grades will come to lie in an identical grade. The specific recommendations about some categories of these posts made by the Pay Commission are included Section II of Part B. As regards other posts, the posts in these three scales should be merged. In case it is not feasible to merge the posts in these pay scales on functional considerations, the posts in the scale of Rs.5000-8000 and Rs.5500-9000 should be merged, with the post in the scale of Rs.6500-10500 being upgraded to the next higher grade in pay band PB-2 i.e. to the grade pay of Rs.4600 corresponding to the pre-revised pay scale of Rs.7450-11500. In case a post already exists in the scale of Rs.7450-11500, the post being upgraded from the scale of Rs.6500-10500 should be merged with the post in the scale of Rs.7450-11500."

Administrative Officer & Pvt. Secretary are presently in the Pay Scale of Rs.6500-10500. As per the above stipulation, these officers are to be granted a Grade Pay of Rs. 4,600/-equivalent to the pre-revised pay scale of 7450-11,500.

However, in para (v), it is mentioned that :

"Upgradation as in (ii) above may be done in consultation with Department of Expenditure, Ministry of Finance. Regarding (iii) and (iv) above, upgradation may be done by the Ministries concerned in consultation with their Integrated Finance."

Therefore, the Board must issue a suitable order in consultation with the Dept. of Expenditure, for the pay fixation of AO, PS & Inspector, at the ealiest .

Dispensation similar to that of Section Officer and PS in the Secretariat has been granted to Group B Officers of Railways, DANICS & DANIPS, Organised Accounts, etc.

Income Tax Officers, who are Group 'B' Gazetted Officer were at par with the above said officers. Accordingly, we request that ITO on completion of 4 years, must also be granted Grade Pay of Rs. 5400/- in PB-3 and not PB-2. Here, it may be noted that, this demand will not involve any extra financial burden / outlay for the Government.

Notional Effect to the Revised Pay Scale of Inspector & ITO :

The anomaly in the pay scales assigned to the Inspectors and Income Tax Officers, disturbing the parity with similarly placed officers of the CBI / IB was set right on 21/04/2004 by the Govt. of India. However, this order was made effective only from the date of its issue and not from 01.01.1996, the date on which the anomaly arose. The Federations in the Dept. of Revenue had been representing to set right this illogical decision, citing the case of the Accounts Employees in Railways, Postal , IA & AD, Civil Accounts, Ministry of Coal & Mines, etc. In all these organizations the concerned officers were granted the benefit of notional fixation of revised pay with effect from 01.01.1996 and the actual payment with effect from the date of the issue of order. The 6th CPC to whom the matter was referred to, perfunctorily rejected this claim, stating the commission as a general rule was not considering demands seeking retrospective application of some or the other order, unless a clear-cut and manifest anomaly that cannot be corrected, other than through such retrospective revision is made out. The anomaly in this case cannot be set right, except through retrospective application of notional fixation of pay w.e.f 01.01.1996, as has been rightly done in the case of officers of various organizations mentioned above. Failure to set right this anomaly will have a permanent effect extending to the entire service tenure of individual officers concerned.

The need for retrospective revision with effect from 01.01.1996 on a notional basis, is further established from the observation of the Commission in para 7.15.24 of the report wherein the traditional parity of the Chief Enforcement Officer with the ITO/Superintendent of Central Excise and Assistant Enforcement Officer with the Inspector of Central Excise and Income Tax has been admitted and recommended for maintenance in future. On 01.01.1996, Chief Enforcement Officer were in the scale of Rs.7500-Rs.12,500/-. Further, CCS (RP) Rules 2008 has also granted the Grade Pay of Rs. 5,400/- after 4 years to Group 'B' Officers in the Revenue Dept.

Hence, it will be only logical to grant notional fixation w.e.f 01.01.1996, to the revised pay of Inspector & ITO, thereby settling the issue, once and for all, judiciously. In case this demand is acceded to, we can positively consider waiving our right to arrears for the period 21/04/2004 to 31.12.2005.

Kindly refer to our circular dated 15.9.2008 (posted at the Website) intimating you of the decisions taken at the last Sectt. meeting. Subsequently the Central JCA met and the decisions taken at the said meeting has also been communicated to you. We are to organize a mass deputation to all the Chief Commissioners of Income tax on 23rd .We reproduce the Central JCA Circular letter in this regard along with the Charter of Demands and request you to carry out the programmes of action as indicated therein. Today we have sent you the following SMS to all our Sectt. members and the CWC members reiterating the need to see the website and make arrangements for carrying out the programme.

Despite our best efforts, we regret to inform you that the Directorate in charge of Examination and the Board has taken an obstinate position in respect of relaxation of the Examination to be conducted for the year 2008 for no ostensible reason. The CWC will discuss the Board's attitude towards the employees in its meeting and will formulate its views. In the meantime, we are to inform you that on the basis of a petition filed by some employees before the Central Administrative Tribunal, Mumbai, the Tribunal has ordered that there is no reason in imposing an age restriction for taking up the Departmental Examination especially when the recruitment rules do not prescribe any such age restrictions.

Kindly ensure that the programme is carried out with full success.

Sub: Settlement of Charter of Demands.

We submit the charter of demands as approved at the meeting on 14th September, 2008. These are the issues which are pending decision at the Board's level for quite a long time. These have been subjected to discussion on various occasions. On some of the issues, assurances were held out, but not honoured, reasons not made known to us.

This is being submitted through the respective Chief Commissioners of Income tax through a mass deputation for conveying to you the anguish and concern of the employees and officers and the growing discontent, which if not addressed immediately might affect the morale with consequential disruption of the smooth functioning of the Department.

Charter of Demands


1.Immediate implementation of the suggestions made by the JCA in respect of utilization of infrastructure fund.
2.RR of Gr. D. employees be amended as agreed upon. Notify the RR of Inspectors as Group B (Non-Gazetted)
3.Implement the 3 awards granted in 1998 by Board of arbitration
a) FR22(1) (a) (I) benefit to farrash Mali, Sweeper etc. on promotion as peon.
b) Special pay for Inspectors posted in Central circle & in Sr. AR(ITAT)’s office.
c) F.R 22(1)(a)(1) benefit for all inspectors on revision of the pay Scale in 1980.
4. Relax the eligibility criterion for Deptl. Exam. 2008 to allow all candidates who have crossed the age of 55 years and availed ten chances.
b) Reduce the pass marks for Inspectors Exam. to 40 and Ministerial Staff Exam. at 35, as has been done in the case of ITOs Examination..
5.Central Processing Units.
The agreement between the Board and Staff Unions on 23/07/2007 to be adhered to, both in letter and spirit.
6.Regularization of Daily rated workers who have put in ten years of service, as per DOPT order.
7.Filling up of huge vacant posts in the cadre of ACIT/DCIT/JCIT
Grant Ad-hoc promotion in respect of vacancies of R.Y. 2009-10 & 2010-11.
8.Create Leave Reserves, as existed up to the year 2001
9.Restructuring the cadre of Admn. Officers & Pvt. Secretaries in the ratio of 2:1
The matter is pending with the Board for more than 4 years. There is severe stagnation amongst the rank & file of AOs & PS. The re-structuring suggested is in line with the scheme as existing in CBEC i.e. Central Excise & Customs Dept.
11 Implement the interim order of the Hon’ble Supreme Court, in the case of all similarly placed Inspectors.
12 Implement all decisions arrived at in earlier meetings, including transfer back of Shri G.Gopalan to T.N.
13 Impart training to all employees and Officers on system related changes.
