Dear Comrades,

 

The Central JCA met at Chennai on 1st December 2008 instead of 29th November 2008 as scheduled earlier. The meeting deliberated upon the issues and noted that:

 

(a) the transfer orders issued by the CBDT in respect of officers on promotion as ACs have not been fully modified as per the assurance held out to the effect that

(i) Officers would be accommodated in any one of the charges out of the three options ;

(ii) Officers whose children are studying in X or XII class would be retained in the espective charges till 31.03.2009 ;even though, out of 53 officers, cases relating to 21 has been modified, thereby leaving 32 Officers, in the lurch.

 

(b) the oral assurance held out by the Member (P) to gradually cover all employees in the mobile phone scheme, who are deployed for operational assignments.

 

(c)      the orders amending the R/R of Gr.-D has not been issued, even though the demand is in consonance with the Guidelines issued by Deptt. of Personnel.

 

(d)      Orders in respect of changing the Grade Pay of Inspectors, AOs, PS, DPA Gr.-B and ADI(OL) have not been issued, in spite of the positive direction in CCS (RP) Rules, 2008 notified on 29.08.2008, for implementing the 6th CPC recommendations.

 

After thorough deliberation, it was decided that in appreciation of the efforts undertaken by the Member (Personnel), [who had taken over the portfolio only very recently] to resolve the issues, the on-going agitation in respect of non-submission of Statistical reports etc. should be withdrawn forthwith, as a goodwill gesture on our part to evolve a congenial atmosphere for facilitating further meaningful discussions.

 

However, since there had been no explicable reason for the delay in issuance of orders concerning up-gradation of Pay Scales of Inspectors, AO, PS etc. and amend the Rectt. Rules of Gr.-D employees, the meeting also decided to continue with the non-co-operation in respect of Survey/Search and Seizure operations. The meeting especially noted the fact that the Board could ensure that the injustice done in the assignment of Pay Scales for Members, CBDT by the Committee of Secretaries could be got reversed, whereas orders to give effect to the up-gradation of Pay Scales of Inspectors, AO, PS, etc. in consonance with CCS (RP) Rules 2008 issued vide Govt. notification dated 29.08.08, has been kept pending, till date, for no plausible reason.

                 

Resolution adopted at the meeting and sent to the Board is enclosed. Accordingly, the affiliates are requested to advise their members to submit statistical reports as is required, for and from the month of December onwards, while the survey/search operation will continue to remain the non-co-operative areas till the Central JCA undertakes the next review of the on-going agitation.

Resolution

 

The Central JCA, which met to-day reviewed the course of negotiation, the representatives of the Federations had with the Chairman and Member (P) on the 14th November 2008 and with the Member (Personnel) subsequently. Though assurances were held out to settle some of the issues in the 13-Point Charter of Demands by 28th November 2008, the meeting noted with regret that even the minutes of the said meeting has not yet been issued and the assured settlement has not come about. However, taking into account the oral assurances held out by the Member (Personnel) on certain issues and his all out effort to bring about a solution to the issues concerning the transfer of Asst. Commissioners on promotion, amendment to recruitment rules of Gr.-D employees, utilization of Infrastructure funds, the up-gradation of the Grade Pay of Inspectors, AOs, PS,DPA, ADI (OL) etc. on the basis of the notified rules of the Govt. of India in acceptance of the 6th CPC recommendation, even though none of the above issues have reached finality, the meeting has decided to suspend the on-going agitation of non-submission of Statistical reports etc.. Since the orders, as promised in respect of transfer of officers who are promoted, recruitment rules and up-gradation of Pay scales of Inspectors etc. has not yet been issued, the meeting decided to continue with the non-co-operation in the matter of Survey, Search and Seizure operations. The meeting felt that the Board will endeavor to instill a little urgency in the issuance of orders on the above demands immediately, [on which formal decisions to accede to the demands has already been taken] so that the non-co-operation in the matter of survey/search operation could also be called off paving way for a congenial atmosphere in the Department. The meeting noted with happiness that the arbitrary denial of the appropriate Pay Scale to the Members of CBDT (as recommended by the 6th CPC) by the Committee of Secretaries have been reversed by the Govt. raising the prestige and status of the CBDT in the Governmental set up.

 

            The meeting has asked the Joint Convenors to send the Resolution to the CBDT to convey the decision of the meeting.
